PERSONAL DATA PROTECTION NOTICE

A. Introduction

This Notice describes the collection, processing and disclosure of your personal data by ForLife Research Sdn Bhd (“4Life”). 4Life reserves the right to modify, update or amend this Notice at any time. You are advised to monitor this Notice for changes at 4Life website. English version of this Notice prevails in the event of discrepancies between the two versions of this statement.

By providing your personal data, continuing your 4Life business or accepting bonuses or commissions from 4Life, you are deemed to have read and consented to the processing of your personal data in the manner prescribed here. If you provide third party personal data, you represent and warrant that you have obtained the third party’s consent for the processing of their data by 4Life.

B. Collection of Personal Data

Personal data collected may include, but not limited to, your personal details provided in the Affiliate Application and Agreement or information contained in any engagements, meetings and correspondence between 4Life and you, or your contact list data (including the name, telephone number, contact ID, and any other contact information contained in the user’s contact list) (“Personal Data”). Personal Data may be in the form of data, photographs or moving images.

The provision of your Personal Data is voluntary. You may disagree or subsequently withdraw your consent to the processing of your Personal Data. However, 4Life will be unable to administer your Affiliate Account or facilitate any Purposes outlined in Paragraph D below.

C. Source of Collection of Personal Data

The source of your Personal Data includes but is not limited to information gathered from registration forms, purchase forms, online portals, sales transactions, open events, requests for further services or to contact about 4Life products and services and any other interactions with 4Life as necessary for the purpose of business operations and in compliance with legal requirements.

D. Purposes of Collecting Personal Data

Your Personal Data may be used for, but not limited to, the purposes below:

a) to facilitate payments related to business transactions between 4Life and you;
b) to notify you about 4Life’s promotions, incentives, events, road shows and trainings;
c) to deliver 4Life products or marketing materials to you;
d) to contact you for verification purposes or to conduct market surveys;
e) to market, promote and provide you with information relating to 4Life business;
f) for internal administrative purposes, such as auditing, data analysis, service improvement and compliance with internal policies and procedures;
g) to comply with or make disclosures under the legal or regulatory requirements;
h) regarding other lawful activities related to 4Life.

E. Disclosure to Third Parties

Your Personal Data may be disclosed to the following third parties:

a) authorised agents or third-party service providers for Purposes stated in Paragraph D above;
b) professional advisors, such as 4Life’s auditors, legal advisors and financial advisors;
c) other 4Life entities worldwide;
d) government bodies, regulatory bodies or other authorities if and when required;
e) any other persons or bodies for purpose incidental or ancillary to Paragraph D above.

Your Personal Data may be stored or consolidated with 4Life’s centralized worldwide database. In this circumstance, 4Life shall also ensure similar level of protection of your Personal Data.

F. Processing of Personal Data

4Life may process your Personal Data for purposes necessary for the performance of a contract with you and 4Life’s legitimate interests provided that those interests do not override any of your own interests, rights and freedoms which require the protection of personal data. This includes processing for marketing, business creation, development, management, and statistical and research purposes, which will include analysis and tracking of transactions and the creation of marketing profiles. You have the right to object to this processing which 4Life relies on for a legitimate interest or for direct selling or network marketing (collectively, “direct selling”) purposes.

4Life may process your Personal Data for certain additional and specific purposes, and in these limited circumstances 4Life will obtain your separate consent which you will also have the right to withdraw. 4Life may process your Personal Data for more than one lawful grounds depending on the specific purpose for which 4Life is using your data.

G. Accuracy of Personal Data

4Life will take all practicable and reasonable steps to ensure that your personal information is accurate, complete and up to date. Please keep 4Life informed if there are changes to your personal information of which 4Life needs to be made aware.

H. Security of Personal Data

4Life has appropriate security protocols to mitigate the risks of inadvertent loss, unauthorized access, misuse, or alteration of the information furnished by you. Access to your Personal Data is restricted to authorized personnel, including employees, agents, contractors, and relevant third parties, who require such access for legitimate business purposes. These authorized parties are bound by contractual obligations to process your Personal Data solely according to suspected instances of data security breaches. 4Life will promptly notify you and pertinent regulatory bodies of any suspected breaches in compliance with legal obligations.

I. Retention of Personal Data

4Life will only retain your Personal Data for as long as it is necessary to fulfil the purposes for which it is collected. The retention period is determined by the nature and duration of your relationship with 4Life which includes but are not limited to the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which 4Life processes your Personal Data and whether 4Life can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances 4Life may anonymise or pseudonymise the Personal Data so that it can no longer be associated with you, in which case 4Life may use such information without further notice to you.

J. Access, Correction and Limitation to Processing of Personal Data

You may request for access to or update of your Personal Data, make inquiries or complaints as well as limit the processing of your Personal Data for marketing or promotional purposes. Contact 4Life at the nearest office or submit your request using the details in Paragraph K below.
